Attestations

Records Retrieval has been hit hard with the new HIPAA Attestation ruling. DAS is proactively working to comply with these requirements to avoid rejections from medical facilities. We’ve noticed most providers will not release medical records without an Attestation Statement signed directly by the requesting attorney or party. DAS cannot sign these attestations on behalf of the requester or otherwise represent the individual seeking PHI. 

OPTION 1: ESIGN FORM

To streamline this process, DAS offers an e-signature option for the HIPAA Attestation form. By signing this form, firms grant DAS permission to apply the necessary job information (Name on Record, Facility Name, Date) to the form. 

You have the option to give us permission to use this signed form on ALL current and future cases or submit one for each case you request records on. If you would like this to apply to ONE case, please fill out the optional Records Of Name. Once signed, we will complete the required details (Name on Record, Facility Name, Date) before submitting the requests to the respective facilities. The signed Attestation Statement will be used for existing requests that face rejections due to this requirement, and future requests submitted by you.

OPTION 2: SUBMIT FOR EACH REQUEST

For those who opt not to use the general e-signature form, please note:

  • DAS will require a signed Attestation Statement for each request.
  • You can provide a signed form when placing your order, or DAS will create one and email it to you for signature after placing the order.
  • The completed and signed form must be returned to DAS before we can process your requests with the facilities.
